Cargus claim deadlines, liability and evidence
Cargus compensates loss and damage at the RON equivalent of USD 2.50 per kilogram of missing gross weight, and caps delay at the shipping fee. The claim window is six months from posting for the courier service, but only 30 days for damage or loss and 21 days for delay on the goods-transport service.
Tightest deadline
At hand-over
Standard cap
Goods transport: USD 2.50/kg; RON 23,000 if extended
Liability regime
Mixed
Cargus publishes two claim regimes in one document, and which one applies depends on the service booked rather than on what happened. Under the courier service a complaint may be made within six calendar months of submitting the consignment. Under the shipping-of-goods service the same events carry 30 days for partial or total deterioration, 30 days for loss or theft counted from when the delivery should have arrived, and 21 days for late delivery. A shipper who reads the six-month figure and files on day 40 of a goods shipment is out of time by ten days.
Claim windows
One set of terms covers a postal courier service and a goods-transport service with different deadlines and different ceilings. Edition 23 of the terms sets both; nothing here is inferred from the other.
Loss or partial deterioration noticed at hand-over
At hand-over
Counted from delivery.
The consignee and the Cargus courier draft findings Minutes. Otherwise it is assumed the service was provided correctly and the delivery arrived in good condition.
Courier service: any claim
6 calendar months
Counted from the date of submission of the postal consignment.
Applies to loss, theft, partial or total damage and delay on the courier service. Filed in writing, by email, at a Cargus office or contact point, or by telephone.
Goods transport: partial or total deterioration
30 days
Counted from delivery to the recipient.
In writing. A different regime from the courier service above, under the same terms.
Goods transport: loss or theft
30 days
Counted from the date the delivery should have been made.
Counted from the date delivery was due, not from the last scan.
Goods transport: late delivery
21 days
Counted from delivery to the recipient.
The tightest window Cargus publishes.

3 calendar months
Counted from the date of filing the complaint.
Compensation is then paid within 30 calendar days of a favourable outcome, without exceeding the three-month term.
Insured versus uninsured
No additional cover
For the shipping service, total or partial loss is compensated at the RON equivalent of USD 2.50 per kilogram of missing gross weight at the BNR rate on the date of the event. Partial damage or destruction is compensated at the depreciation in the value of the goods, subject to the same USD 2.50 per kilogram limit. On loss or total destruction Cargus also refunds the service fees collected on pick-up, plus legal penalty interest.
With cover bought
Liability can be extended against a percentage fee on the declared value, but only if the relevant box on the Transport Note is filled in and the fee is paid. The extension is capped at RON 23,000, or RON 1,000 as the case may be, and does not cover indirect or special damages.
Delay and late delivery
Capped at the fees for the shipping service. For cash-on-delivery consignments handed over without collecting the COD amount, Cargus is liable for the entire COD value and has a right of recourse against the consignee.
Evidence required
- The order for the shipping service
- The Transport Note
- The waybill
- The invoice for the goods
- Findings Minutes drawn up at hand-over, where loss or deterioration was visible then
- Other documents proving the event and the delivery that is the subject of the claim
- The original packaging of the delivery, where applicable
- Bank details, where payment of compensation into an account is requested
Exclusions
- Fortuitous events and force majeure
- Indirect losses and damages, including loss of profit, income, interest, markets, auctions, reputation and opportunity
- Deliveries received without objection by the consignee, except claims about loss, theft, damage or destruction of the contents
- Damage arising from the action or inaction of the consignor or the consignee
- Cases where the user has no service in place for receiving postal shipments, such as a registry
- Inappropriate packaging by the user
Filing the claim
- Who files
- For the courier service the complaint may be brought by either the consignor or the consignee. It is addressed to the Customer Relations Department.
- How to file
- In writing by email to sesizari@cargus.ro, by any postal service, or by submitting it at the registered office or any staffed access point; or by telephone through Customer Relations. The claim must document the event and attach the evidence for it.
- Processing time
- Claims are resolved within three calendar months of filing. Compensation follows within 30 calendar days of a favourable outcome, or within 30 days of receiving the claimant’s damages invoices. A delivery declared lost that is later found becomes Cargus property one year after damages were paid. The limitation period for court proceedings is one year.
What quietly kills Cargus claims
The six-month window is the courier service only. On the goods-transport service the same loss is out of time after 30 days, and a late delivery after 21. The service booked decides the deadline, not the incident.
The RON 23,000 figure quoted all over the Romanian web is the ceiling on extended liability, not the standard cover. Without the box on the Transport Note ticked and the fee paid, the limit is USD 2.50 per kilogram.
The per-kilogram limit is calculated on missing gross weight, so a light, valuable parcel is worth very little: two kilograms lost is USD 5.00 of cover regardless of contents.
If nothing is recorded in findings Minutes at hand-over, the terms presume the delivery arrived in good condition, and the claimant argues uphill from there.
FAQ
How long do I have to claim from Cargus?
Six calendar months from submitting the consignment for the courier service. For the shipping-of-goods service it is 30 days for partial or total deterioration, 30 days for loss or theft counted from when delivery was due, and 21 days for late delivery.
Does Cargus really cover up to RON 23,000?
Only if liability was extended: the box on the Transport Note must be filled in and the percentage fee on the declared value paid. Standard cover is the RON equivalent of USD 2.50 per kilogram of missing gross weight, and the extension excludes indirect and special damages.
What does Cargus pay for a late delivery?
Compensation for shipping delays cannot exceed the fees for the shipping service, and the claim must be communicated in writing within 21 days of delivery on the goods-transport service.
